Impeachment
There has been a great deal of discussion about impeaching President Donald Trump. The politics associated with the impeachment, has brought out the most partisan bickering in years. Trump supporters believe that the impeachment proceedings are more of a continuing witch hunt. Trump's detractors believe that an impeachment is warranted, because of a Phone call To the Ukrainian President. Some random thoughts about the hullabaloo.
When I first heard about the telephone call in question, I thought, well isn't that what we pay Trump to do; talk to other Presidents? I thought what is the big deal. Trump has to be able to talk to other leaders. He has to be able to do this without having his every move, and word, micro analysed. That is one of the products of the political climate for which Trump is partially responsible.
While Trump should be afforded some leeway in his interactions with other world leaders. What he should not be doing is asking foreign leaders to open a closed investigation on a political, or perceived political rival. There is a reason we don't let foreign nationals, or immigrants that aren't citizens vote. We can't have anyone but Americans choose our leaders, or laws. We also can't have undue influence from a foreign nation.
Trump has enough resources at his disposal to do his Constitutional duties, there is no need to involve his personal attorney. A personal attorney who does not have the proper clearance, to be involved in discussions, and decisions concerning National Security. If Trump would have been, discussing National Security matters, then a government lawyer should have to have been used. Only lawyers with a security clearance, should have been involved.
The United States has a what is called The United States of America and Ukraine on Mutual Legal Assistance in Criminal Matters. Article 2 of this Treaty enumerates that; "Article 2 provides for the establishment of Central
Authorities and defines Central Authorities for purposes of the
Treaty. For the United States, the Central Authority shall be
the Attorney General or a person designated by the Attorney
General. For Ukraine, the Central Authority shall be the
Ministry of Justice and the Office of the Prosecutor General.
The article provides that the Central Authorities shall
communicate directly with one another for the purposes of the
Treaty."
Trump and Attorney General or AG Barr, both have stated they hadn't spoken about the call. So Trump alone does not have the authority to ask the President of Ukraine anything, concerning crime, and criminals in Ukraine. Only AG Barr does.
What The whistle blowers lawyer wrote or said three years ago has nothing factual to do with the act. All other bs aside, Trump asked a foreign President, in an official capacity, to reopen a closed investigation into a political rival, for purposes of subverting a Presidential election. That is a violation of his oath, a high crime and misdemeanor, and thus an impeachable offense. That is the only fact of law. What Biden did or didn't do has nothing to do with what Trump did. If Biden and his son are dirty, then gather the evidence and take it to a grand jury. Pointing to bad behavior, to excuse, or deflect focus from other bad behavior, is bad character, and even worse ethics.
The Republicans need to concentrate on what the President did, not what everyone else did. Trump is the President, and as such should be held to higher standard ethically. This business about attacking the process, and the people with unproven, and reckless innuendo, is bad for our Republic. It was bad when Clinton did it, and it is bad now that Trump is doing it. They all, from both sides need to stop the partisan bickering and stop trampling on the Constitution, and start governing.
